By accessing or using the website at zerone.ca (the "Website"), creating an account, or purchasing services from ZerOne Performance Inc. ("ZerOne," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Website or services.

ZerOne operates the following brands: Hockeyology (hockey development and training), Athleticare (allied health care services), and Labs (sports science and technology). These terms apply to all services offered under any ZerOne brand.

2. Account Registration

To access certain features of our Website, including booking services and managing memberships, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

For Hockeyology services involving minor athletes, a parent or legal guardian must create the account and register the athlete. The parent or guardian is responsible for all activity, bookings, and purchases made under the account.

3. Services and Bookings

Hockeyology

Hockeyology offers hockey development programs, training sessions, memberships, and related services. Services are booked and managed through our integrated booking system powered by Mindbody. Class schedules, availability, and pricing are subject to change. Membership benefits, including access to the class schedule and member pricing, are active only while the membership is in good standing.

Athleticare

Athleticare provides allied health care services including physiotherapy, massage therapy, dietitian consultations, psychological services, and physician services. Appointments are booked through the Athleticare booking portal. Health services are subject to the professional standards and regulations governing each discipline in the Province of Alberta.

Skate Science Lab

The Skate Science Lab offers skate sharpening services, blade alignment consultations, and related products. Punch pass products entitle the holder to a specified number of services as described at the time of purchase.

4. Payments and Refunds

All prices are listed in Canadian dollars (CAD) and are subject to applicable taxes. Payment is processed at the time of purchase through our secure third-party payment processor. We accept major credit and debit cards.

5. Memberships

Hockeyology memberships provide access to the class schedule, member pricing on programs and services, and other benefits as described at the time of enrollment. Membership terms, pricing, and benefits are subject to change with reasonable notice. Cancellation policies will be provided at the time of enrollment and are governed by the membership agreement.

6. Assumption of Risk and Liability

Participation in athletic training, sports performance programs, and physical activities involves inherent risks of injury. By registering for and participating in Hockeyology programs, you acknowledge and accept these risks on behalf of yourself and any minor athletes registered under your account.

ZerOne, its employees, contractors, and affiliates shall not be liable for any injury, loss, or damage arising from participation in programs or use of facilities, except where caused by our gross negligence or willful misconduct. Participants may be required to sign waivers or assumption of risk forms prior to participation in certain programs.

7. Intellectual Property

All content on this Website, including text, graphics, logos, images, software, and design elements, is the property of ZerOne Performance Inc. or its licensors and is protected by Canadian and international copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this Website without our prior written consent.

The ZerOne, Hockeyology, Athleticare, and Labs names and logos are trademarks of ZerOne Performance Inc.

8. Acceptable Use

You agree not to:

• Use the Website for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Website, other accounts, or computer systems
• Submit false, misleading, or fraudulent information
• Use automated tools, bots, or scripts to access the Website or submit forms
• Interfere with or disrupt the operation of the Website

9. Third-Party Services

Our Website integrates with third-party services including Mindbody (booking and payments) and TELUS CHR (Athleticare health records). Your use of these services is also subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

To the maximum extent permitted by applicable law, ZerOne Performance Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Website or our services. Our total liability for any claim arising out of or relating to these terms shall not exceed the amount you paid to us for the specific service giving rise to the claim.

You agree to indemnify, defend, and hold harmless ZerOne Performance Inc., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the Website, violation of these terms, or infringement of any third-party rights.
